Terms & Conditions

  • Website designs will be checked in the latest version of Internet Explorer, Firefox, Chrome and Safari at the time of site presentation for sign-off, but will not necessarily display as well in earlier versions of the browsers.
  • Please note that self-hosted online shops will need updating periodically for security reasons (as new patches and versions are released). These updates will be at the client’s expense, but will not be done without the client’s consent. Evocative Marketing reserves the right to refuse to continue hosting, or arranging hosting, for any site which it considers to present a security risk.
  • Once a website design in completed and signed-off, any further changes to it requested (including those prompted by changes in browser rendering) are chargeable at Evocative Marketing’s hourly rate.
  • If Evocative Marketing is unable to complete any work quoted or agreed (for example, in the event of illness or injury) then attempts will be made to notify the client as quickly as possible, but no compensation will be given for any inconvenience or cost incurred by the client as a result of any missed deadline and/or unfinished work by Evocative Marketing.
  • Although Evocative Marketing will not knowingly infringe the copyright of any other individual or organisation, no trademark searches will be done by Evocative Marketing at any stage. Therefore, it is the client’s responsibility to ensure that trademark searches and checks are made if required. Evocative Marketing accepts no responsibility for any costs or inconvenience incurred by the client in the event that work provided co-incidentally resembles that belonging to another organisation or individual.
  • It is the client’s responsibility to ensure that any work produced by Evocative Marketing is checked extremely carefully before it is signed-off. Once work is signed-off any changes requested by the client are subject to additional fees, if accepted. Evocative Marketing takes no responsibility for any errors or omissions in signed-off work.
  • Additionally it is up to the client to ensure that any artwork, logo, letterhead or other material produced by Evocative Marketing complies with any legislation corresponding to the client’s industry. Where there are legal restrictions on advertising and/or branding, such as in the Financial Services industry, it is the client’s responsibility to inform Evocative Marketing of these in writing before any work is started. Evocative Marketing will not check that any advertising or branding meets specific industry regulations and accepts no liability for any problems arising as a result of any work not meeting these if the client has signed-off the work. The client will indemnify Evocative Marketing for any costs arising from signed-off work not meeting specific industry legislation.
  • Until work is signed-off and paid for in full, it is the property of Evocative Marketing and must not be published or used in any way by the client.
  • The Intellectual Property rights to any website code written by Evocative Marketing will remain with Evocative Marketing. Therefore other web designers will not be given permission to alter code written by Evocative Marketing, except in the event that Evocative Marketing were ever to cease trading. Third party code used remains the intellectual property of the developers.
  • Evocative Marketing reserves the right to use sub-contractors in conjunction with the fulfilment of any part of the work agreed.
  • The copyright of any logos, photos, illustrations, copy, or other materials supplied to Evocative Marketing for inclusion in a piece of work, must belong to the client and Evocative Marketing accepts no liability for any problems arising from the usage of client-supplied materials in work prepared for the client. The client warrants that any material provided to Evocative Marketing for the purpose of providing the work specified in the quotation will not infringe the copyright or rights of any third party, and the client shall indemnify Evocative Marketing against any loss, damages, costs, expenses or other claims arising from any such infringement.
  • Evocative Marketing will attempt to provide the specified service with reasonable care and skill and as far as reasonably possible within any time limits agreed in writing.
